1. Purpose
This Conflict Resolution & Governing Law Policy establishes the framework for addressing disputes arising from the use of the MahaBachatGat Consultancy Portal (“Portal”) and clarifies the applicable governing law and jurisdiction.
The objective of this Policy is to encourage fair, efficient and amicable resolution of disputes while recognising the independent relationship between Consultants and Service Buyers.
This Policy shall be read together with the Portal’s:

• Disclaimer

• Privacy Policy
• Other applicable Portal policies.
2. Scope
This Policy applies to:
• Registered Consultants
• Service Buyers
• Visitors
• Organizations
• Educational Institutions
• NGOs
• Government Bodies
• Any person accessing or using consultancy.mahabachatgat.in.
3. Nature of the Portal
The Portal functions solely as an independent technology platform facilitating the discovery of professional consultancy services and enabling initial communication between Consultants and Service Buyers.
The Portal is not:
• a contracting party;
• an employer;
• an agent;
• a broker;
• an escrow service;
• a payment intermediary;
• an arbitrator;
• a mediator;
• a professional regulator.
Accordingly, the Portal’s involvement is limited to the operation and administration of the Platform.
4. Portal-Related Disputes
The following matters may be addressed through the Portal’s internal grievance process:
• account registration issues;
• profile approval or rejection;
• Platform Registration Fee payment issues;
• account suspension or termination;
• Portal policy violations;
• misuse of the Portal;
• content moderation decisions;
• technical issues;
• privacy concerns;
• intellectual property complaints relating to Portal content.
Such matters shall ordinarily be dealt with in accordance with the Grievance Redressal Policy.
5. Consultant–Service Buyer Disputes
Consultancy engagements are entered into directly between the Consultant and the Service Buyer.
Accordingly, disputes concerning:
• consultancy fees;
• consultancy agreements;
• project execution;
• quality of services;
• professional advice;
• deliverables;
• timelines;
• contractual obligations;
• refunds between the parties;
• taxation relating to consultancy assignments;
• intellectual property created during consultancy assignments,
shall be resolved directly between the Consultant and the Service Buyer.
The Portal does not adjudicate such disputes and is not responsible for their resolution.
6. Encouragement of Amicable Resolution
The Portal encourages Consultants and Service Buyers to attempt to resolve disputes amicably through good-faith discussions before initiating formal legal proceedings.
Where appropriate, parties may voluntarily agree to mediation, conciliation or any other lawful alternative dispute resolution mechanism.
The Portal is under no obligation to participate in or facilitate such proceedings unless it expressly agrees to do so.
7. Internal Review
Where a dispute relates to the administration of the Portal, users may request an internal review in accordance with the Grievance Redressal Policy.
The Portal may:
• seek additional information;
• review available records;
• communicate with the concerned parties;
• issue administrative decisions regarding Portal operations.
Such review is intended solely for Portal administration and does not determine the legal rights or obligations arising under private consultancy agreements.
8. Cooperation with Authorities
The Portal may cooperate with:
• courts;
• law enforcement agencies;
• regulatory authorities;
• statutory bodies;
• governmental agencies,
where required under applicable law or pursuant to lawful orders, notices or directions.
9. Governing Law
This Policy, together with all Portal policies, shall be governed by and interpreted in accordance with the laws of the Republic of India.
Users agree that their use of the Portal shall be subject to applicable Central and State laws, including laws relating to contracts, information technology, intellectual property, taxation, consumer protection and data protection, as applicable.
10. Jurisdiction
Subject to any mandatory provisions of applicable law, the courts having jurisdiction at Chhatrapati Sambhajinagar, Maharashtra, India, shall have exclusive jurisdiction over disputes arising out of or relating to the operation of the Portal and its policies.
This jurisdiction clause does not prevent the Portal from initiating or defending legal proceedings before any competent court or authority where necessary to protect its rights or comply with applicable law.
11. Alternative Dispute Resolution
Nothing in this Policy prevents parties from mutually agreeing to resolve disputes through:
• negotiation;
• mediation;
• conciliation;
• arbitration,
where such mechanisms are lawful and mutually accepted.
Unless expressly agreed in writing, the Portal shall not be deemed a party to or administrator of any such proceedings.
12. Limitation of the Portal’s Role
The Portal shall not be liable for resolving disputes arising from:
• consultancy contracts;
• consultancy fees;
• project outcomes;
• business decisions;
• professional advice;
• commercial negotiations;
• taxation;
• intellectual property ownership created during consultancy assignments.
The Portal’s role is limited to administering its own Platform and enforcing its published policies.
13. Good Faith Cooperation
Users are expected to cooperate in good faith during any review conducted under the Portal’s Grievance Redressal Policy.
Submission of false, misleading or malicious information during a dispute resolution process may constitute a violation of Portal policies and may result in administrative action.
14. Survival
The provisions relating to governing law, jurisdiction, limitation of the Portal’s role, indemnification and liability shall survive:
• account suspension;
• account termination;
• deletion of user accounts;
• discontinuation of Portal services,
to the extent permitted by applicable law.
15. Policy Amendments
The Portal reserves the right to amend this Policy periodically to reflect changes in law, judicial decisions, regulatory requirements or operational practices.
The latest version published on the Portal shall supersede all previous versions.
Continued use of the Portal after publication of amendments constitutes acceptance of the revised Policy.
