SERVICE BUYER POLICY
(For SHGs, Women Entrepreneurs & Other Users)

1. Purpose
The MahaBachatGat Consultancy Portal (“Portal”) has been established to facilitate professional connections between qualified Consultants and Self Help Groups (SHGs), Women Entrepreneurs, Farmer Producer Organizations (FPOs), Cooperatives, NGOs, MSMEs, Startups, Educational Institutions, Government Organizations and other individuals or organizations seeking consultancy, advisory, mentoring, training or other professional services.
The Portal functions as a digital consultancy directory and professional networking platform, enabling Service Buyers to identify suitable Consultants, compare their expertise, communicate directly with them and independently engage their professional services.
This Policy defines the rights, responsibilities and obligations of every Service Buyer while using the Consultancy Portal.
2. Scope
This Policy applies to every visitor, registered user and Service Buyer accessing or using consultancy.mahabachatgat.in for searching, comparing, contacting or engaging Consultants.
This Policy shall be read together with the Portal’s:
• Terms & Conditions
• Privacy Policy
• Disclaimer
• Consultant Registration & Service Listing Policy
• Code of Ethics
• Grievance Redressal Policy
• and all other applicable Portal policies.
3. Nature of the Consultancy Portal
The Consultancy Portal is a technology-enabled information, discovery and networking platform.
Its primary purpose is to facilitate professional connections between independent Consultants and prospective Service Buyers.
The Portal enables Service Buyers to:
• search Consultants by profession or expertise;
• browse consultant profiles;
• compare consultancy services;
• review qualifications, certifications and experience disclosed by Consultants;
• view indicative consultancy fees;
• contact Consultants directly using the published contact information;
• request quotations or proposals; and
• independently engage Consultants.
The Consultancy Portal does not:
• employ Consultants;
• appoint Consultants on behalf of users;
• recommend or certify any Consultant;
• negotiate consultancy assignments;
• execute consultancy contracts;
• supervise consultancy projects;
• monitor professional performance;
• collect consultancy fees;
• process consultancy payments;
• issue consultancy invoices;
• guarantee consultancy outcomes.
The Portal merely provides the digital infrastructure for facilitating initial professional contact.
4. Eligibility
Any individual or legally recognized organization capable of entering into legally binding agreements under the applicable laws of India may use the Consultancy Portal.
Service Buyers may include, without limitation:
• Self Help Groups (SHGs)
• Women Entrepreneurs
• Individual Entrepreneurs
• Startups
• MSMEs
• Farmer Producer Organizations (FPOs)
• Cooperative Societies
• Trusts
• NGOs
• Educational Institutions
• Government Departments
• Companies
• Professionals
• Individual Users
Users shall provide complete, accurate and updated information wherever required.
5. Selection of Consultants
The selection, appointment and engagement of a Consultant is solely the responsibility of the Service Buyer.
Before appointing any Consultant, Service Buyers are strongly encouraged to independently verify:
• educational qualifications;
• professional experience;
• statutory registrations;
• licenses;
• certifications;
• memberships of professional bodies;
• references;
• previous assignments;
• technical competence;
• consultancy fees;
• expected deliverables;
• timelines.
Information published by Consultants is provided by them independently.
Unless expressly stated otherwise, the Portal does not independently verify every professional qualification, certification, licence or claim published on consultant profiles.
Accordingly, Service Buyers should exercise independent judgement and reasonable due diligence before engaging any Consultant.
6. Consultancy Engagement
The Consultancy Portal facilitates only the initial introduction between Service Buyers and Consultants.
Once contact has been established, all subsequent communications shall occur directly between the Consultant and the Service Buyer through telephone, email, WhatsApp, video conference, physical meetings or any other mutually agreed communication method.
The Consultant and the Service Buyer shall independently negotiate and agree upon:
• scope of work;
• consultancy methodology;
• project schedule;
• deliverables;
• milestones;
• consultancy fees;
• payment terms;
• taxes;
• reimbursement of expenses;
• confidentiality obligations;
• intellectual property rights;
• ownership of work product;
• cancellation terms;
• termination;
• dispute resolution;
• and all other contractual matters.
The Consultancy Portal shall not be a party to such negotiations or agreements.
7. Consultancy Fees and Payments
Consultancy charges displayed on the Portal are determined solely by the respective Consultants and are published only to provide indicative pricing information to prospective Service Buyers.
Service Buyers shall negotiate consultancy charges directly with the Consultant.
All consultancy fees shall be paid directly to the Consultant through payment methods mutually agreed between the Consultant and the Service Buyer.
The Consultancy Portal:
• does not collect consultancy fees;
• does not receive consultancy payments;
• does not process consultancy transactions;
• does not operate escrow services;
• does not deduct commissions;
• does not collect brokerage;
• does not issue consultancy invoices;
• does not collect GST relating to consultancy assignments;
• does not deduct TDS on consultancy payments.
The Portal is therefore not responsible for any financial transaction conducted between Service Buyers and Consultants.
8. Due Diligence
Service Buyers are advised to exercise reasonable commercial and professional judgement before appointing any Consultant.
Where appropriate, Service Buyers should independently verify:
• identity;
• statutory registrations;
• PAN;
• GST registration;
• professional licenses;
• references;
• previous work;
• legal compliance;
• financial credentials;
• professional reputation.
Before commencement of consultancy assignments, Service Buyers are encouraged to execute appropriate legal documentation, including:
• Consultancy Agreements;
• Non-Disclosure Agreements (NDAs);
• Confidentiality Agreements;
• Intellectual Property Agreements;
• Work Orders;
• Service Level Agreements (SLAs);
• Project Engagement Letters;
or any other documents considered appropriate for the proposed assignment.
9. Confidential Information
Service Buyers should exercise appropriate caution before sharing confidential, proprietary, commercial, financial, technical or personal information with Consultants.
Where confidentiality is important, suitable Confidentiality or Non-Disclosure Agreements should be executed directly between the parties.
The Consultancy Portal shall not be responsible for maintaining confidentiality between Consultants and Service Buyers or for any unauthorised disclosure occurring outside the Portal.
10. Professional Advice
Consultants registered on the Portal may provide professional advice in various fields including:
• Business Development
• Entrepreneurship
• Finance
• Taxation
• Accounting
• Legal Compliance
• Marketing
• Branding
• Digital Marketing
• Information Technology
• Artificial Intelligence
• Agriculture
• Food Processing
• Skill Development
• Government Schemes
• MSME Development
• Exports
• Project Reports
• Social Development
• CSR
• Human Resource Management
• Quality Certification
• Intellectual Property
• and other professional disciplines.
The Consultancy Portal neither endorses nor guarantees the accuracy, completeness, legality or suitability of any professional advice provided by Consultants.
Service Buyers shall independently evaluate the suitability of such advice before implementation.
11. Ratings and Reviews
Service Buyers may voluntarily publish ratings and reviews based upon their genuine experience.
Reviews shall:
• be truthful;
• be fair;
• be respectful;
• avoid abusive language;
• avoid defamatory content;
• avoid misleading statements;
• avoid promotional material.
The Portal reserves the right to moderate, edit, reject or remove reviews that violate applicable laws or Portal policies.
12. Fraud Prevention and Responsible Use
Service Buyers shall not:
• impersonate another person or organization;
• submit false information;
• misuse Consultant contact information;
• solicit unlawful services;
• publish fake reviews;
• attempt fraudulent transactions;
• misuse Portal resources;
• harass Consultants;
• upload unlawful content;
• violate intellectual property rights.
Violation of this Policy may result in suspension, restriction or permanent termination of Portal access.
13. Complaints
Service Buyers may report complaints regarding:
• inaccurate Consultant information;
• misleading service listings;
• unethical conduct;
• misuse of the Portal;
• policy violations.
The Portal may review such complaints for determining compliance with Portal policies and may take administrative action where appropriate.
However, the Portal does not adjudicate contractual, commercial or financial disputes arising from consultancy engagements conducted between Consultants and Service Buyers.
14. Limitation of the Portal’s Role
The Consultancy Portal serves solely as a digital platform facilitating professional discovery and communication.
The Portal does not warrant or guarantee:
• the professional competence of every Consultant;
• authenticity of every qualification;
• service quality;
• project completion;
• commercial success;
• financial gains;
• legal compliance by Consultants;
• customer satisfaction;
• achievement of intended results.
The decision to appoint any Consultant rests entirely with the Service Buyer.
15. Limitation of Liability
To the maximum extent permitted under applicable law, the Consultancy Portal, its owners, administrators, employees, affiliates and technology partners shall not be liable for any direct, indirect, incidental, consequential, special or punitive loss arising from:
• consultancy engagements;
• consultancy advice;
• project delays;
• project failures;
• contractual disputes;
• payment disputes;
• taxation issues;
• intellectual property disputes;
• confidentiality breaches;
• negligence by Consultants;
• business decisions made by Service Buyers.
The Service Buyer voluntarily assumes all risks associated with engaging independent Consultants through the Portal.
16. Policy Amendments
The Portal reserves the right to amend, revise or update this Policy from time to time to reflect changes in applicable laws, operational requirements or business practices.
The latest version published on the Portal shall supersede all previous versions.
Continued use of the Portal after publication of revised policies shall constitute acceptance of such revisions.
17. Acceptance
By accessing or using consultancy.mahabachatgat.in, every Service Buyer acknowledges and agrees that:
• the Portal functions solely as a digital consultancy directory and networking platform;
• Consultants are independent professionals and not employees, agents, representatives or partners of the Portal;
• consultancy agreements are entered into directly between the Consultant and the Service Buyer;
• consultancy fees are paid directly to the Consultant and are never collected by the Portal;
• the Portal is not responsible for consultancy services, contractual obligations, financial transactions, taxation, professional advice or disputes arising between the Consultant and the Service Buyer.
Continued use of the Portal constitutes unconditional acceptance of this Service Buyer Policy and all other applicable policies governing the MahaBachatGat Consultancy Portal.
