1. Purpose
The MahaBachatGat Consultancy Portal (“Portal”) respects intellectual property rights and is committed to protecting the legitimate rights of Consultants, Service Buyers, the MahaBachatGat Ecosystem and third parties.
This Intellectual Property Policy establishes the principles governing ownership, use, licensing and protection of intellectual property made available through the Portal.
It also defines the responsibilities of all users in respecting intellectual property rights while using the Portal.
2. Scope
This Policy applies to:
• Registered Consultants
• Service Buyers
• Visitors
• Guest Users
• Portal Administrators
• Employees and authorised representatives of the MahaBachatGat Ecosystem
• Any person accessing or using consultancy.mahabachatgat.in
This Policy shall be read together with the Portal’s Terms & Conditions, Privacy Policy, Consultant Policy, Service Buyer Policy and Disclaimer.
3. Intellectual Property of the Portal
Unless otherwise stated, all intellectual property relating to the Consultancy Portal is owned by or lawfully licensed to the MahaBachatGat Ecosystem.
This includes, without limitation:
• Portal name
• Logos
• Trademarks
• Service marks
• Domain names
• Website design
• User interface
• Source code
• Databases
• Software
• Graphics
• Icons
• Layout
• Navigation structure
• Documentation
• Policy documents
• Original text content
• Audio and video content
• Marketing material
• Digital assets
These intellectual property rights are protected under applicable copyright, trademark and other intellectual property laws.
4. Ownership of Consultant Content
Consultants retain ownership of the intellectual property rights in the original content uploaded or published by them, including:
• Professional profiles
• Business descriptions
• Service descriptions
• Articles
• Blogs
• Research papers
• Training material
• Templates
• Reports
• Presentations
• Videos
• Images
• Software
• Methodologies
• Educational material
• Publications
• Original documentation
Uploading such material to the Portal does not transfer ownership to the Portal.
5. Licence Granted to the Portal
By uploading or publishing content on the Portal, the Consultant grants the Portal a non-exclusive, worldwide, royalty-free, revocable licence to:
• display the content;
• host and store the content;
• reproduce the content for Portal operations;
• optimise content formatting;
• promote Consultant listings through Portal marketing;
• create search indexes;
• generate previews and thumbnails;
• maintain backup copies;
• improve Portal functionality.
This licence exists solely for operating, maintaining and promoting the Consultancy Portal and does not transfer ownership of the Consultant’s intellectual property.
6. Ownership of Consultancy Deliverables
Reports, project documents, feasibility studies, training manuals, software, presentations, templates or other work products prepared by a Consultant during a consultancy engagement shall be governed by the agreement entered into between the Consultant and the Service Buyer.
The Consultancy Portal is not a party to such agreements and does not determine ownership of consultancy deliverables.
Consultants and Service Buyers are encouraged to clearly define ownership and licensing rights in their Consultancy Agreement before commencement of any assignment.
7. Copyright Protection
Users shall not, without lawful authority:
• copy Portal content;
• reproduce Portal material;
• modify Portal content;
• distribute copyrighted material;
• publish Portal documents elsewhere;
• sell Portal content;
• create derivative works using Portal content.
Similarly, users shall respect the copyrights of Consultants and third parties.
8. Trademarks
“MahaBachatGat”, “Women’s Portal”, “Consultancy Portal”, associated logos, branding elements, slogans and other distinctive marks are valuable intellectual property of the MahaBachatGat Ecosystem or their respective owners.
Unauthorised use, reproduction, imitation or registration of confusingly similar marks is prohibited without prior written permission.
9. User Responsibilities
Every user shall ensure that material uploaded to the Portal:
• is original or lawfully licensed;
• does not infringe copyrights;
• does not violate trademarks;
• does not misuse patents;
• does not infringe design rights;
• does not violate trade secrets;
• does not misappropriate confidential information;
• complies with applicable laws.
Users are solely responsible for the legality of the content they publish.
10. Third-Party Intellectual Property
The Portal respects the intellectual property rights of third parties.
Users shall not upload or publish material that infringes:
• copyrights;
• trademarks;
• patents;
• industrial designs;
• geographical indications;
• trade secrets;
• confidential information;
• proprietary software licences.
Any infringement remains the sole responsibility of the user who uploaded or published such material.
11. Artificial Intelligence (AI) Generated Content
Consultants may use Artificial Intelligence (AI) tools to assist in preparing reports, presentations, marketing material or other content.
However, Consultants remain fully responsible for ensuring that AI-assisted content:
• is accurate;
• complies with applicable laws;
• does not infringe intellectual property rights;
• does not violate confidentiality obligations;
• is suitable for professional use.
The Portal does not verify whether uploaded content has been generated or assisted by Artificial Intelligence.
12. Confidential Information
Consultants and Service Buyers may exchange confidential information during consultancy engagements.
Such information may include:
• business strategies;
• financial information;
• technical data;
• trade secrets;
• research;
• customer information;
• manufacturing processes;
• proprietary methodologies.
The Consultancy Portal does not monitor or control confidential exchanges occurring outside the Portal.
Users are encouraged to execute appropriate Confidentiality Agreements or Non-Disclosure Agreements before sharing sensitive information.
13. Intellectual Property Complaints
Any person claiming infringement of intellectual property rights may submit a written complaint containing:
• name and contact details;
• description of the intellectual property;
• ownership details;
• description of the alleged infringement;
• location of the infringing material;
• supporting documents;
• declaration of good faith.
The Portal may review the complaint and, where appropriate, remove or disable access to the disputed material pending further investigation.
14. Repeat Infringers
The Portal reserves the right to suspend or permanently terminate accounts of users who repeatedly infringe intellectual property rights or violate this Policy.
Such action may be taken without prior notice where necessary to protect legitimate intellectual property interests.
15. Limitation of Responsibility
The Consultancy Portal functions as an intermediary technology platform for publication of Consultant profiles and related information.
The Portal does not independently verify ownership of every document, image, logo, trademark, report, presentation or other intellectual property uploaded by users.
Responsibility for ensuring lawful ownership or licensing of uploaded content rests entirely with the respective user.
16. Policy Amendments
This Intellectual Property Policy may be amended periodically to reflect changes in applicable laws, judicial decisions, operational requirements or technological developments.
The latest version published on the Portal shall supersede all previous versions.
Continued use of the Portal constitutes acceptance of the revised Policy.
